1.1 These Terms and Conditions ("Terms") govern every booking of passenger‑only ferry services made through the website www.seyferry.com ("Site") or via any other sales channel operated by SunMediaSitours GmbH, Rottweg 39, 5020 Salzburg, Austria ("SeyFerry", "we", "us").
1.2 SeyFerry acts exclusively as booking agent. The contract of carriage is concluded directly between you ("Customer") and the relevant ferry operator ("Carrier"). The Carrier’s own conditions of carriage apply in addition to these Terms and take precedence for matters of transport safety, schedules, embarkation, baggage and passenger behavior.
1.3 We maintain written agency agreements with each Carrier under which the Carrier undertakes to remedy operational problems such as over‑booking, timetable changes or mechanical failure at no additional cost to you, for example by supplying an alternative vessel or accommodating you on the next suitable sailing.
1.4 Your booking relates solely to a single ferry transport service and therefore does not constitute a package travel arrangement within the meaning of Directive (EU) 2015/2302, the UK Package Travel, Package Holidays and Package Tours Regulations 1992 or any successor legislation.
2.1 By completing the online booking form, ticking the checkbox confirming your acceptance of these terms and pressing “Pay now”, you submit a binding offer. The contract between you and the Carrier is concluded only when an electronic ticket voucher or written confirmation is dispatched by SeyFerry on the Carrier’s behalf.
2.2 We reserve the right to refuse a booking without stating reasons until the confirmation is issued.

2.4 We cannot guarantee confirmation of a Cat Cocos booking that is made less than 72 hours before departure (96 hours on weekends), even if an electronic voucher is issued. This limitation is due solely to the response times required for final acceptance by the Carrier.
2.5 By placing a booking you warrant that you are authorised to act on behalf of every person named in the booking and, for passengers under 18 years, on behalf of their parent or legal guardian. You confirm that all named passengers accept these Terms and undertake to communicate all confirmation details and relevant information to them. You accept full responsibility for all payments due under the booking.
2.6 You warrant that you are 18 years of age or over and have full legal capacity to use the site and to enter into binding contracts.
2.7 You warrant that all personal information submitted during the booking process is complete and accurate and that you accept financial responsibility for all transactions effected under your name or account.
2.8 You hereby authorise SeyFerry to process all personal information relating to you and to the passengers named in the booking - including, without limitation, telephone numbers, email addresses, residential addresses, signatures and ID or passport data - for the sole purpose of performing the contract of carriage and providing related customer services. Such processing is carried out in compliance with Regulation (EU) 2016/679 (GDPR), Directive 2002/58/EC and any legislation that amends, complements or replaces them.
2.9 Electronic booking confirmations, vouchers, payment receipts and our system logs constitute conclusive evidence of the contract and related transactions, save for manifest error.
3.1 All fares are displayed in euro (EUR, €) and are VAT‑exempt cross‑border passenger transport (§ 6 Abs 1 Z 3 lit a Austrian UStG).
3.2 Accepted payment methods: major credit/debit cards, payment providers and SEPA bank transfer (transfer must reach us ≥ 3 banking days before departure).
3.3 If port dues, government taxes or Carrier tariffs rise after booking but before travel, we may invoice the difference. Failure to settle before departure entitles us to cancel the booking and refund your payment.
3.4 We reserve the right to allocate any incoming payment to outstanding invoices at our discretion; payments need not be matched to the specific booking referenced in the transfer. If you have an unpaid invoice and make an on‑account payment for another ferry trip, we may apply that payment first to settle the unpaid invoice.
3.5 Payment processing is executed via secure payment service providers compliant with PSD2 Strong Customer Authentication. Any currency‑conversion or card‑issuer fees applied by your bank are outside SeyFerry’s control and are payable by you.
Passenger transport services tied to a specific date are exempt from the 14‑day consumer withdrawal right. Once confirmed, your booking can only be altered or cancelled in accordance with §5.
5.1 Carrier‑specific rules for Cat Cocos
You may amend your booking free of charge until three working days before departure. If the amended sailing falls into a higher or lower fare bracket we will charge or refund the fare difference accordingly. Within the final 72 hours one date‑ or time‑change is permitted, subject to seat availability and Carrier approval; any further change within this period is treated as a cancellation and incurs a 100 % fee. Amendments requested within 24 hours of sailing - or for departures on Monday or Tuesday (because the Sunday amendment desk is closed) - must be made in person at the Cat Cocos office and any amendment fee levied by the Carrier must be paid on site.
Flight delays
If your inbound flight is delayed or cancelled you may usually be transferred to the next available ferry without surcharge provided (a) seats are available, and (b) we receive your written notice at delay@seyferry.com within two hours of the airline’s delay/cancellation announcement and, in any case, at least two hours before the scheduled ferry departure (Seychelles time). This goodwill accommodation is not a legal entitlement. Failure to notify us in time will classify you as a no‑show and the booking will incur a 100 % fee.
Cancellations
You may cancel any Cat Cocos booking free of charge until three working days before departure; cancellations within this window and no‑shows incur a 100 % fee. SeyFerry processes all refunds to the original payment method once the Carrier confirms the cancellation.
5.2 Carrier‑specific rules for Cat Rose
You may amend or cancel your booking free of charge up to 24 hours before departure. If you have already completed the outbound sector (e.g. Praslin → La Digue) and hold a return ticket, you must cancel the unused sector at least 48 hours before departure by (a) submitting the online form to SeyFerry, (b) notifying Inter Island Ferry directly, and (c) returning the unused paper ticket to the quay office. Changes or cancellations after these deadlines, as well as no‑shows, are subject to a 100 % fee.

5.4 All amendment or cancellation requests must be submitted via the online form provided on the Site; the server timestamp of receipt determines whether a deadline has been met. All refunds are processed by SeyFerry to the original means of payment.
6.1 Ferry timetables are subject to weather, port or operational changes without prior notice. The Carrier may substitute vessels or cancel sailings.
6.2 Where operational issues occur (e.g. over‑booking, schedule change or mechanical failure), the Carrier will use best endeavours to transport you on the next suitable sailing or arrange an equivalent vessel at no additional cost to you. If fulfilment proves impossible, your sole remedy is a full refund of the affected sector’s fare; we accept no liability for accommodation, onward travel or consequential loss.
6.3 Force Majeure - Neither the Carrier nor SeyFerry is liable for any change, cancellation, loss, damage or other effect on your booking caused by events or circumstances beyond our reasonable control. Examples of force majeure include, but are not limited to, war, revolution, terrorist acts, closure of borders, epidemic or pandemic, natural catastrophe, or any other unforeseeable events that seriously affect the parties. Where force majeure prevents proper performance, the obligations of both parties are suspended for the duration of the event.
6.4 Because the contract of carriage is concluded with the Carrier, any claims or complaints relating to performance of the transport (including personal injury, service quality or schedule changes) must be addressed directly to the Carrier; please also notify SeyFerry at info@seyferry.com so we can assist.
7.1 SeyFerry’s contractual duty is limited to the correct processing of your booking. We are not liable for performance of the carriage contract nor for personal injury, death, damage or loss arising during transport. Claims must be directed to the Carrier.
7.2 Subject to mandatory law, our liability for damages resulting from slight negligence is excluded; for gross negligence and wilful misconduct it is capped at the total price paid for the booking.
7.3 Nothing in these Terms limits liability for personal injury or death caused by SeyFerry’s own negligence or for fraudulent misrepresentation.
7.4 We do not independently audit or certify the Carriers and make no representation regarding the suitability, quality or accuracy of their services or published information. Listing a Carrier on the Site does not constitute an endorsement or recommendation. We disclaim liability for any misrepresentation, breach of contract, breach of statutory duty or negligence by any Carrier or other service provider.
8.1 You must hold valid identification, visas and any required vaccination or health certificates for every jurisdiction on your itinerary. SeyFerry is not liable for any expense, delay, loss or denial of boarding resulting from missing, incomplete or incorrect documentation or your non‑compliance with entry, health or customs requirements; no refund will be issued in such circumstances.
8.2 SeyFerry is not liable for damages or losses that may result from travel to any particular destination. Government travel‑advice services in your country of residence can help travellers stay safe overseas; you should consult the latest official advice regarding the Seychelles (and any transit countries) both when booking and immediately before departure.
8.3 Passengers must follow all safety instructions (seat assignments, life‑jacket briefings, mask mandates or similar health measures) issued by the crew.
8.4 The Carrier and/or SeyFerry may deny carriage or terminate the journey without refund and recover resulting costs if you endanger safety, obstruct operations or violate laws.
You are strongly advised to obtain comprehensive travel insurance before you travel. It is solely your responsibility to ensure that the policy is adequate. At minimum, cover should include: costs of cancellation or curtailment initiated by you; loss, theft or damage to personal property; all overseas medical expenses and hospitalisation; emergency assistance and repatriation to your country of residence in the event of accident or illness.
Processing of personal data complies with Regulation (EU) 2016/679. Details are set out in our Privacy Policy, which forms an integral part of these Terms. Our separate Cookie Notice explains how cookies and similar technologies are used on the Site.
11.1 We may modify the content of the Site and/or these Terms at any time. Such modification becomes effective immediately upon posting on the Site; your continued use or access will be deemed acceptance of the modified content and/or Terms.
11.2 Any information on the Site concerning Carriers or other service providers – including, without limitation, descriptions of vessels, facilities, schedules or ancillary services – is provided by the respective Carrier. These Carriers are independent businesses and are neither our agents nor our employees.
11.3 This information is for general reference only and does not constitute advice or a recommendation by SeyFerry. We do not verify it and are not liable for inaccuracies or omissions. Independent businesses provide the services in accordance with their own terms and conditions (apart from the cancellation rules set out in §5) which may limit or exclude their liability to you.
11.4 SeyFerry and its affiliates are not liable for any acts, omissions, breaches of contract, breaches of statutory duty or negligence of any independent service provider, nor for any resulting damage or expense. In particular, we are not liable for refunds in the event of over‑booking, force majeure or any other cause beyond our reasonable control.
11.5 Because we act solely as booking agent, we have no responsibility for errors in travel documentation except where those errors are made by SeyFerry itself.
11.6 All intellectual‑property rights in Site content are owned by or licensed to SeyFerry. Reproduction, scraping or automated querying is prohibited without prior written consent.
11.7 The Site is provided on an "as‑is" and "as‑available" basis; SeyFerry does not warrant uninterrupted access or error‑free operation and accepts no liability for any unavailability or technical malfunction.
12.1 In the highly unlikely event that you have reason to complain or experience any problem with your ferry provider, please inform the ferry staff or management immediately so that they can take prompt corrective action. Kindly also contact SeyFerry with the details - booking number, dates, evidence - within 14 days by emailing info@seyferry.com or via our online form. Any Carrier that receives multiple legitimate complaints may be removed from the Site.
12.2 SeyFerry is neither obliged nor willing to participate in ODR procedures.
13.1 These Terms are governed by Seychelles substantive law, excluding its conflict‑of‑law rules and the UN Convention on Contracts for the International Sale of Goods.
13.2 Exclusive place of jurisdiction is the court competent for Seychelles. If you are a consumer habitually resident in the EU, you may also bring proceedings in your local court pursuant to Art 18 (1) Brussels I bis Regulation.
14.1 We may modify these Terms at any time. The version in force at the moment of booking applies.
14.2 If any provision of these Terms is or becomes invalid, the remaining provisions shall remain in full force. The invalid clause shall be replaced by a valid provision that most closely reflects the commercial intent of the original.
